These Terms of Service govern your use of Yard-Sale.ai ("we", "us", or "our") at yard-sale-ai.netlify.app and any related service (the "Service"). By using the Service, creating an account, or publishing a store, you confirm that you have read, understood, and agree to these Terms and to the Privacy Policy.

Service description

Yard-Sale.ai is an online tool for creating a personal "yard sale" page. The Service lets you:

• Create an account (via email and password or a Google account) and choose a username that becomes your store's personal link.
• Upload photos of items for sale or giveaway.
• Use AI tools (Google Gemini) to automatically identify an item — name, description, and category — and suggest a price. Price suggestions and descriptions are estimates only; you are responsible for reviewing, editing, and approving every detail before publishing.
• Manage your store — edit details, set prices, mark items as sold, and configure currency, language, WhatsApp number, and pickup location.
• Share one link to your store on social media and elsewhere, so buyers can view items and contact you directly.

What the Service is not: Yard-Sale.ai is a display and information platform only. We are not a party to any transaction between seller and buyer, do not process payments, and are not responsible for the quality, legality, or condition of items.

Eligibility

• Minimum age — You must be 18 or older, or 13 or older with the consent and supervision of a parent or guardian. The Service is not intended for children under 13.
• Legal capacity — You must have the legal capacity to enter into a binding agreement in your country of residence.
• Accurate details — You must provide accurate, current information and keep your login credentials confidential. You are responsible for all activity under your account.
• Lawful use — You must use the Service in compliance with all applicable law, and sell only items you are legally permitted to sell.

We may suspend or close any account that does not meet these eligibility requirements or that violates these Terms.

Your listings and content

• You keep ownership — The photos, descriptions, and content you upload ("your content") remain yours.
• Limited license — By uploading content, you grant us a non-exclusive license to store, display, and process it solely to operate the Service for you — creating your sale page, showing it to anyone who visits your link, and sending images to AI analysis at your request. This license ends when you delete the content or your account.
• Your responsibility — You are solely responsible for the content you publish and represent that: you have all rights to publish it and sell the items; the descriptions, prices, and condition are accurate and not misleading; and the content does not infringe any third-party rights.
• Removal — We may, but are not obligated to, remove content or suspend a store if we believe it violates these Terms or the law.

Prohibited content

You may not upload, publish, or offer:

• Items whose sale is prohibited by law (weapons, drugs, hazardous materials, protected animals, counterfeit goods, etc.).
• Content that infringes another's copyright, trademark, or intellectual property.
• Content that is offensive, threatening, racist, defamatory, pornographic, or that promotes violence or hatred.
• False or misleading information about an item, its price, or its condition.
• Another person's personal information without their consent.
• Malicious code, harmful links, or attempts to harm the Service or its users.

Violating this section may lead to content removal, suspension or closure of your account, and legal liability.

AI-generated content disclaimer

The Service uses AI (Google Gemini) to suggest item names, descriptions, categories, and price estimates. These outputs are suggestions and estimates only, and are not professional advice or a binding valuation. They may contain inaccuracies or prices that do not reflect true value, and are not the responsibility of Yard-Sale.ai. Full responsibility for reviewing, editing, pricing, and approving content before publishing rests solely with you. Reliance on AI outputs is at your own risk.

Transactions between users

Yard-Sale.ai is a display and information platform only. We are not a party to any transaction between seller and buyer:

• We do not process payments, broker money, or hold transaction funds.
• All negotiation, payment, delivery, and coordination happen directly between seller and buyer and are their sole responsibility.
• We are not responsible for the quality, legality, safety, or condition of items, and do not guarantee that any transaction will be completed.
• We recommend caution in dealings with people you don't know — meet in a public place and inspect the item before paying.

The Service is provided "as is," without warranty of any kind. To the extent permitted by law, we are not liable for any direct or indirect damages arising from use of the Service or from transactions between users.

Changes to these Terms

We may update these Terms from time to time. For material changes, we will update the "Last updated" date at the top of the page. Continued use of the Service after an update constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

Governing law

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-law rules. Exclusive jurisdiction over any dispute relating to the Service lies with the competent courts of the Tel Aviv-Jaffa district, Israel.
